Terms of Sale
Please read the following terms of sale carefully. You must agree to these before ordering products from our website.
(1) Definitions
Within these terms of sale, “we”, “our” and “us” refer to Delves Wood Bears, and “you” and “your” refer to our customer or potential customer.

(3) Order and Contract Process - Standard Checkout
To enter an order you must take the following steps:
(a) Add any items you wish to purchase to your shopping cart.
(b) If you are a new customer, you must create an account with us.
(c) If you are an existing customer, you must enter your log in details.
(d) When logged in, you may be asked to select a delivery option. The default option will be free delivery.
(e) You will then be asked to select a payment method. The default method is credit/debit card secured by PaymentSense. PaymentSense is Tier-1 PCI compliant, making this a very secure way to pay by credit or debit card. You can also pay by PayPal.
(f) You must agree to our terms of sale, then confirm your order.
(g) You will be transferred to the secure payment website where you will enter your credit/debit card details (or log in to PayPal, if you chose that option) and payment will be processed.
(h) You will receive prompt acknowledgement of your order.
(i) After checking whether we can meet your order, we will either send you an order confirmation (at which time your order will become a binding contract), or we will notify you that we are unable to meet your order.
(j) The contract will be concluded using the English language.
(4) Order and Contract Process - Google Checkout
To enter an order you must take the following steps:
(a) Add any items you wish to purchase to your shopping cart.
(b) Click Google Checkout.
(c) You will be transferred to the Google Checkout website where you will be able to view our terms of sale, and where your payment will be processed.
(d) You will receive prompt acknowledgement of your order.
(e) After checking whether we can meet your order, we will either send you an order confirmation (at which time your order will become a binding contract), or we will notify you that we are unable to meet your order.
(f) The contract will be concluded using the English language.
(5) Price and Payment
The prices of our products are shown on our website. Prices may change at any time, but will not affect contracts which have already been entered into.
In addition, you may have to pay a delivery charge, which will be indicated before you submit your order.
Full payment must be made upon submission of your order. Products will not be despatched until payment is received from you in full. Payment must be made by one of the methods detailed on the website.
(6) UK Delivery
Products will be delivered to the shipping address specified on your order.
Special delivery items are usually despatched directly to your chosen shipping address from our supplier, with delivery usually taking place within 1-4 working days. Free Delivery is the only valid shipping option for these items. Please ensure that there is someone available to sign for your order at your given delivery address.
Pre-ordered items will usually be shipped within 24 hours of becoming available. On some occasions, due to delays beyond our control, an item may not become available on the expected in-stock date. In this event we will notify you of the delay via email.
We aim to despatch in stock items ordered before 3:00pm on a working day, on the same day. We aim to despatch in stock items ordered after 3:00pm, on the following working day.
If your order contains a combination of pre-order and in stock items, they will all be despatched together. Special delivery items will be despatched separately, directly from our supplier.
An estimated date for delivery will be specified on our order confirmation, and we aim for delivery to take place on or before this date. We cannot guarantee delivery by this date, but we do guarantee that products will be despatched within 30 days of the date of our order confirmation.

(7) Collection
Items are available for collection. We currently offer a 10% discount on this service. In stock items are usually available for collection straight away during normal working hours Monday to Friday, though they can be collected during the evening or on weekends. We will call you to arrange a mutually convenient time. If for any reason you need to reschedule, please call us as soon as possible on 01406 370 638 or 07806 652 719 or email us to arrange an alternative time. Failure to do so will result in this discount being removed.
(8) EU Delivery
We deliver our smaller teddy bears and soft toys (i.e. not our giant teddy bears or giant soft toys) to EU member countries, using either Royal Mail's Airsure or Royal Mail's 'International Signed For' service. 'Interntaional Signed For' delivery usually takes place within 3-5 working days, following despatch from Delves Wood Bears. with Airsure being about 1 day faster. We use Airsure where it is available, because of it's faster and more secure service (as it is scanned and tracked all the way to your door). 'International Signed For', requires a signature on delivery.
Giant soft toys can be delivered by special arrangement. Please contact us for a no obligation quote.
If your order contains a combination of pre-order and in stock items, they will all be despatched together.

(9) International Delivery
With a couple of extra conditions, we now deliver our smaller teddy bears and soft toys (i.e. not our giant teddy bears or giant soft toys) to select international countries, using either Royal Mail's Airsure or Royal Mail's 'International Signed For' service. 'Interntaional Signed For' delivery usually takes place within 3-7 working days, following despatch from Delves Wood Bears. with Airsure being about 1 day faster. We use Airsure where it is available, because of it's faster and more secure service (as it is scanned and tracked all the way to your door). 'International Signed For', requires a signature on delivery.
The extra conditions are:
- We will not be held liable for any injury or harm that may be caused from the purchased product(s).
- It's your responsibility to pay any local taxes or charges that may apply internally within the shipping destination country.
Giant soft toys can be delivered by special arrangement. Please contact us for a no obligation quote.
If your order contains a combination of pre-order and in stock items, they will all be despatched together.
If shipping is not configured for your country, please contact us so we can calculate the shipping costs.

(10) Right to Cancel
You have the right to cancel a contract at any time within 7 working days of receiving your products. If you wish to cancel, you must notify us in writing via letter or email within the time limit for cancellation.
You have a duty to take reasonable care of the products throughout the cancellation period while they are in your possession. You will be responsible for returning the products, in "as new" condition (with tags in place), to us within 30 days of cancellation, and for paying for their return. You must take reasonable care to ensure that we receive the products and that they are not damaged in transit. If you fail to return the products we will charge you the direct cost to us incurred in their recovery. If you return the products at our expense we will charge you the direct cost to us incurred in their return.
In the event of a valid cancellation, a full refund of the product price, will be issued as soon as possible and in any case within 30 days of cancellation. Any postage upgrades will not be refunded.
(11) Return of Damaged, Incorrect, or Defective Products within UK and EU
If, on receipt of a product purchased from us, you find that it has been damaged during transit from us, or is not the product you ordered, or is faulty, the product can be returned to us for exchange within 30 days of receipt. Please retain any warranty information supplied with the product, as this may be needed in the event of a fault.
If a product develops a fault after this 30 day period but within 6 months of receipt, you may still be able to return it for exchange if it is reasonable to presume that the fault existed when you first received the product from us.
If a damaged, defective or incorrect product qualifies for return as described above, you will not be required to pay the return costs. Return of damaged or defective item(s) is not always required. Please contact us before returning any item.
The cost of return must be reasonable, i.e. items should be returned in the packaging in which they were received, and items should be returned as cheaply as possible (e.g. via Royal Mail Second Class post in the UK). We will not pay for additional packaging introduced by you, or excess weight costs resulting from the additional packaging.
A refund will be issued where exchange is not possible.
(12) Return of Damaged, Incorrect, or Defective Products from International Destinations
If, on receipt of a product purchased from us, you find that it has been damaged during transit from us, or is not the product you ordered, or is faulty, the product can be returned to us for exchange within 30 days of receipt. Please retain any warranty information supplied with the product, as this may be needed in the event of a fault.
If a product develops a fault after this 30 day period but within 6 months of receipt, you may still be able to return it for exchange if it is reasonable to presume that the fault existed when you first received the product from us.
If a defective or incorrect product qualifies for return as described above, you will not be required to pay the return costs. If the purchased item(s) are damaged during transit, you will be responsible for paying the shipping costs in returning the item(s) to us. (13) Refunds
If you are entitled to a refund, we will usually make the refund via the same method used by you to pay for your purchase. The refund will be processed as soon as possible and in any case within 30 days of the date we received notification of the error, defect or cancellation from which the entitlement to refund has arisen.
(14) Product Images
Images on our website provide a good representation of the products we sell. The actual products, however, may differ slightly from these images.
(15) Limitation of Liability
The products we sell are intended for personal use only and we will not be held liable for any business losses incurred.
Nothing in these terms of sale will exclude or limit our liability for fraud, death or personal injury caused by our negligence.
(16) Privacy Policy
All personal information relating to your order will be treated according to the terms of our privacy policy.
(17) Website Terms of Use
Use of our website is subject to our website terms of use.
(18) Amendments to the Terms of Sale
These terms of sale may be updated from time to time. In this event, we do not guarantee that the version you have agreed to will remain available for reference on our website. We therefore recommend that you save a copy of the applicable version for your records.
Contracts subject to these terms of sale may only be varied by written agreement signed by both you and us.
(19) Governing Law and Jurisdiction
These terms of sale will be governed by and construed in accordance with English law. Any dispute arising in relation to them will be decided only by the English courts.
(20) Statutory Rights
These terms of sale do not affect your statutory rights.
